Home building contract laws review WA - financial institution survey
Overview
The Department of Local Government, Industry Regulation and Safety (LGIRS) is currently undertaking a review of home building contract laws in Western Australia. The Hon. Dan Caddy MLC, has been appointed to coordinate and assist the review. A key area of focus in this review is the structure of progress payments and the defined stages of residential construction. During initial consultation, stakeholders have raised the statutory regimes for residential construction progress payments that exist in other jurisdictions as a potential model for reform (eg: Domestic Building Contracts Act 1995 (Vic), s.40, Building Regulations 1993 (NT), r.41HA).
To explore this further, we are seeking the views of financial institutions through this survey, which will help inform consideration of whether a similar framework may be appropriate for Western Australia.
Please note that the review is currently in the inquiry phase. Once viable policy options have been identified and considered, a consultation paper will be released for formal public consultation.
The survey is expected to take approximately 15-25 minutes to complete, depending on the level of feedback and additional comments provided. Financial institutions are requested to submit only one response on behalf of your organisation to the survey.
Participation is voluntary, and all responses will be treated confidentially. The information collected will be used to support the Department’s review of home building contract laws. Information provided through this survey may be used to inform the consultation paper, recommendations made to government as part of this review, and future related reviews carried out by the Department. All data will be aggregated and de-identified to ensure that individual responses cannot be attributed to any specific survey respondent.
